You Choose the Shop. Not Your Insurance Company.
Under California law, the choice of where your vehicle is repaired belongs to you. Here's what the law actually says, why insurance companies push their own shops, and how to make sure your car is repaired to the standard it deserves.
Plain English
California Insurance Code §758.5(a) is clear:
“No insurer shall require that an automobile be repaired at a specific automotive repair dealer.”
That's the law. It means your insurance company cannot force you to use their preferred shop. They can suggest one only if you ask, or if they clearly disclose it's part of their Direct Repair Program (DRP) network.
Why They Push Their Shops
Insurance companies aren't trying to find you the best shop. They're trying to find the cheapest repair that closes your claim.
Their preferred shops, often branded as Direct Repair Program (DRP) or “in-network” shops, have signed contracts agreeing to:
- Use aftermarket or salvage parts instead of OEM
- Meet aggressive turnaround times (speed over quality)
- Accept below-market labor rates
- Refer claims back to the insurer instead of advocating for you
When an adjuster recommends a shop, they're not recommending the one that will repair your car best. They're recommending the one that saves their employer money.
What You Actually Lose
The money the insurance company saves isn't free. It comes out of the quality of your repair.
Aftermarket & Salvage Parts
Direct Repair Program (DRP) shops agree to use cheaper aftermarket or salvage parts to meet insurance cost targets. On a new vehicle, this can void your factory warranty and compromise safety system performance.
Skipped OEM Procedures
Manufacturer-required procedures, like specific welding sequences, paint preparation, or ADAS recalibration, take time. Shops under volume contracts skip steps to hit turnaround targets. You don't see it until something fails.
Compromised Repairs
DRP contracts reward speed and margin. That means partial repairs instead of full replacement, cheaper blending shortcuts in paint matching, and pressure to close the job before the repair is truly complete.
Voided Manufacturer Warranty
Many automakers, BMW, Mercedes, Audi, Tesla, Lexus, require OEM parts and certified repair procedures. A repair done with aftermarket parts at a non-certified shop can void your factory warranty on affected systems.
How to Push Back
If your adjuster pressures you to use their preferred shop, you only need one sentence:
“Under California Insurance Code §758.5, I'm choosing my own shop. Please process the claim with Crash Lab in Lake Forest.”
That's it. You've cited the specific code. You've named your shop. The adjuster is now on notice that they cannot steer you without violating California law.
If they push further, or claim your rates won't cover it, or threaten to deny the claim, that's a potential violation of the Fair Claims Settlement Practices Regulations. Document the conversation (adjuster's name, date, what was said), and report it to the California Department of Insurance at (800) 927-4357.

Is my insurance company legally allowed to require a specific shop?
No. California Insurance Code §758.5(a) prohibits insurers from requiring you to use a specific automotive repair dealer. Any adjuster who tells you otherwise is misstating the law.
What if the adjuster says my claim won't be covered unless I use their shop?
That's a violation of California Insurance Code §758.5 and Title 10 of the California Code of Regulations §2695.7 (Fair Claims Settlement Practices). Document the conversation, note the adjuster's name and date, and report it to the California Department of Insurance at (800) 927-4357.
Will choosing my own shop cost me more out of pocket?
No. Your insurance is obligated to cover the cost of a safe, proper repair at the shop of your choice, subject to your deductible. If the insurer's initial estimate is lower than the shop's written estimate, the shop and insurer negotiate supplements directly, you don't pay the difference.
What if my insurance guarantees their preferred shop's work?
